1. Acceptance of Terms

By accessing or using our SaaS platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Dewberry IT Analytics LLC provides a business intelligence platform that displays:

  • Advertising performance analytics

  • Business KPIs and operational metrics

  • Quarterly (Q1–Q4) financial analytics

  • Business credit score monitoring

The Service is analytics and monitoring only. We do not facilitate financial transactions, investments, loans, or credit decisions.

3. Subscription & Pricing

  • Monthly subscription: $29.99 per month

  • All fees are billed in advance on a monthly basis

  • Subscription fees are non-refundable except as required by law

  • We reserve the right to change pricing with 30 days' notice

4. Payment Terms

Payments are processed through Shopify Payments or third-party gateways. You authorize us to charge your provided payment method each billing cycle. Late payments may result in suspension of Service.

5. Cancellation & Refunds

You may cancel at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. No refunds for partial months.

6. User Responsibilities

You agree to:

  • Provide accurate information

  • Maintain security of your account credentials

  • Use the Service only for lawful business purposes

  • Not misuse or attempt to reverse engineer the Service

7. Data & Privacy

Our collection and use of personal data is governed by our Privacy Policy. You retain ownership of your business data. We do not sell your data to third parties.

8. No Financial or Credit Advice

The Service provides analytics and data visualization only. We do not provide financial, investment, or credit advice. All decisions based on our Service are solely your responsibility.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Dewberry IT Analytics LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the prior 3 months.

11. Indemnification

You agree to indemnify and hold harmless Dewberry IT Analytics LLC from any claims arising from your violation of these Terms or applicable laws.

12. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any disputes shall be resolved in Madison County, Kentucky.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of modified Terms.
